Colorado’s new law governing gamete banks, fertility clinics, and gamete agencies, the Donor-Conceived Persons Protection Act, is effective January 1, 2025. Fairfax Cryobank was proud to work closely with the US Donor Conceived Council and other stakeholders as this bill was drafted and to contribute to the Colorado Department of Public Health and the Environment’s regulatory drafting process.
The law sets strict requirements for which donor sperm samples are eligible to be provided to clients in Colorado. Starting with samples produced on January 1, 2025, gamete banks and other entities covered by the law can only provide samples from ID Option (identity release) donors who are 21 or over to Colorado residents. Gamete banks also must follow strict, specific practices to ensure each donor is limited to 25 families worldwide and to obtain follow-up health history information from each donor.
The FDA requires us to quarantine sperm samples for six months after they are produced, so Fairfax Cryobank will begin making samples from donors subject to the Colorado requirements available starting around July 2025.
Because the law applies only to donor sperm samples produced on or after January 1, 2025 Colorado clients are still permitted to order any donor sperm samples on our site that were produced prior to that date. Those samples include specimens from non-ID donors and donors who are covered by our existing family unit policy. Please contact our Client Services team for a list of Colorado compliant donors while we work on a new Colorado donor search, which should be available by January 10th.
The law also requires us to provide educational materials to Colorado recipients before they purchase donor sperm. These materials will be sent to Colorado recipients along with their Terms of Use and must be acknowledged before a purchase is completed.
